Code 151.309 is the section of Collierville Code that evaluates the validity of a variance. In theory, the applicant must meet a high threshold of proof for approval. At this board meeting we will see how the theoretical application of these laws meet reality. The intent of FAR zoning laws are to protect the privacy and natural beauty of Collierville from over development. Some think they are more equal than others. I ask this board to apply the law equally, as intended and written.
We the Owen Family at 620 Bray Station Rd oppose granting a variance to 560 Bray Station Rd due to concerns that it will diminish the charm and character of Bray Station Rd. We believe that there is not a hardship which necessitates this variance, but rather the lack of effort/desire to properly design the home to fit on the property. Why should the neighbors be negatively impacted by their hubris?
The FAR zoning law for Bray Station protects the rural charm of Collierville. It could be argued that an almost 10,000 sq foot house, on a 5 acre lot will undeniably impact the character of the adjacent properties. However, when 5 acres is still not enough to accommodate the proposed property, then, it becomes obnoxious. My family fears that the magnitude of this dwelling will inevitably violate our privacy. Please consider complying with the current law, and not the new landowners “wants”.
I signed the FAR rezoning petition in 2000. Existing discrepancies were grandfathered-in.There is NOT one five acre parcel on Bray that meets the 350’ width FAR guideline yet the BMA voted unanimously for the change.It is unfair to pretend that this 293’ lot is 350’ wide in determining the appropriate building envelope. That encroachment of 20% to the north AND to the south is unfair to the existing neighbors. It is an invasion of the privacy that the FAR zoning intended to protect. Thank you.
